COM PLUS CZ a.s., with its registered office at Nad Krocínkou 317/48, 190 00 Prague 9, processes personal data of its customers, suppliers and business partners, or their employees, in connection with its business activities. The protection of your personal data is important to our company. The purpose of this document is to inform you about what we need your personal data for, how we will handle it and what rights you have in this context. When processing your personal data, we act in accordance with the relevant applicable legislation of the Czech Republic and the European Union, in particular Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as the "GDPR"). We are constantly striving to improve the standard of security of your personal data in order to protect it from possible misuse.

Why do we need your personal data?

We process your personal data primarily for the purpose of offering and delivering our products. We need your personal data to record and process your orders and to secure our claims arising from concluded purchase contracts. We also use your personal data to send you sales and marketing communications, informing you about our promotions, news and discounts.

What personal data do we process and where do we get it from?

Personal data means any information about a natural person or data that can be used to directly or indirectly identify that person (e.g. name, date of birth, permanent address, delivery address, e-mail, telephone, etc.). Therefore, personal data does not include data relating to companies and other legal persons (e.g. company number, tax number, registered office, etc.). In the case of self-employed customers, this means the personal data of the entrepreneur concerned, and in the case of business customers, the personal data of the contact persons, usually the customer's employees. We only process personal data that you provide us with in your order. Specifically, this usually includes name and surname, date of birth, address, e-mail and telephone number.

Do we need your consent to process your personal data?

We may process your personal data without your consent in the following cases. In the first instance, these are situations related to order fulfilment. In this case, the legal basis for the processing of your personal data is Article 6(1)(b) of the GDPR - the processing is necessary for the fulfilment of the obligations under the concluded purchase contract, as we need your personal data to record the order and to deliver the goods or services. Subsequently, we use your personal data to fulfil our legal obligations to keep accounting and tax records (in the area of tax and accounting), in which case the legal basis for processing is Article 6(1)(c) of the GDPR, where the processing is necessary to fulfil a legal obligation of the controller. After the delivery of the goods, we store your personal data and details relating to the transaction in case any disagreements arise between us in the future regarding the goods delivered or if the obligations under the concluded contract are not fulfilled properly and on time. In order to be able to enforce our claims under the contract or to successfully defend claims made by you, we store your personal data and process it for the purpose of protecting our rights and legitimate interests, which is a separate legal basis for processing personal data within the meaning of Article 6(1)(f) of the GDPR. We also use the personal data of existing customers to send you commercial communications, information about our news, promotions and special offers. The processing of existing customers' personal data for direct marketing purposes is considered under the GDPR to be processing carried out for the legitimate interest of our company on the basis of Article 6(1)(f) of the GDPR. In none of these cases does the legislation require your consent to the processing of your personal data. Without the processing of your personal data, we would not be able to fulfil our obligations under the concluded purchase contract and deliver the ordered goods to you or enforce the proper performance of your obligations. If you do not wish to receive our further commercial communications, it is sufficient if you object. Please refer to the following paragraph for a more detailed procedure.

What if you do not want to receive our commercial communications?

If you do not wish to receive our commercial communications, please let us know. You can click on the link at the footer of each email message and simply unsubscribe from receiving commercial offers. Alternatively, you can send us an email to: info@www.complus.cz We will process your request as soon as possible and send you back a confirmation that you have been unsubscribed from our commercial communications. You will then no longer receive any of our commercial offers. However, we may still use your personal data in connection with the delivery of the ordered goods or to enforce the obligations under the concluded purchase contract. Who has access to your personal data?

We do not pass on your personal data to third parties for their own marketing purposes. Your personal data can be accessed by employees of COM PLUS CZ a.s. and our business partners who provide individual services for us (transport companies, etc.). We require all persons to whom we disclose your personal data to comply with sufficient standards of security of your personal data and strict compliance with legal obligations in the area of personal data management. Your personal data may only be transferred for processing within the EU. We protect your personal data strictly. We process your personal data both electronically and manually, but in both cases we take security measures, technical, mechanical and organisational. We require at least the same standard of security from our contractual partners as data processors.

How long do we keep your personal data?

We retain your personal data for the period necessary to ensure our mutual rights and obligations under the concluded purchase contract and for the period for which we are obliged to retain such data under the relevant legislation. We use your personal data to send you commercial communications until you object and opt out of receiving commercial communications.

What rights do you have in relation to the processing of your personal data?

You have the following rights in relation to the processing of your personal data:

The right to access your personal data. Do you want to know what data we record about you? Upon your request, we will confirm whether and to what extent your personal data is processed, for what purpose, to which recipients it is disclosed, for how long the data will be stored and what other rights you have in connection with the processing of your personal data. We will provide you with a copy of the personal data processed upon request.

Right to rectification. Has any of your personal data changed? Please let us know as soon as possible. If you notify us, we will update the personal data we hold about you without undue delay and correct any inaccuracies.

Right to erasure. Do not want us to use your personal data? If we no longer need your personal data for the purposes for which we processed it, or perhaps we have processed your personal data unlawfully, we will destroy it without undue delay upon your request.

Right to restriction of processing. Would you like to limit the extent to which we use your personal data? If you ask us to do so, we will restrict the processing of your personal data in the following cases: (i) for the time necessary to verify the accuracy of the personal data if you dispute the accuracy of the data, (ii) we have processed your personal data unlawfully, (iii) we no longer need your personal data for the purposes for which we processed it, and/or (iv) you have objected to the processing of your data for the purposes of protecting our legitimate interests and we have not yet assessed whether your legitimate grounds for the disposal of your data outweigh our legitimate interests. Unlike erasure, in this case your personal data will remain stored by us, but we will not use it for the purposes for which the processing was restricted.

Right to object to the sending of commercial communications. Do you no longer wish to receive our commercial communications, information about our news, promotions and special offers? You can object at any time. Simply click on the link in the footer of each email message and opt out of receiving commercial offers. Or send us an email to: info@www.complus.cz. We will process your request as soon as possible and confirm that you have been unsubscribed from receiving commercial communications. After that, we will no longer use your personal data for marketing purposes.

Right to object. You can also object if you do not consent to the processing of your personal data for the purpose of protecting our legitimate rights and interests other than direct marketing. We will then only process your personal data for the establishment, exercise or defence of our legal claims or where our compelling legitimate grounds for processing outweigh your interests and data protection rights. Please be sure to tell us what specifically bothers you.

Right to notification of a personal data breach. Has your personal data fallen into unauthorised hands? If, despite our best efforts, your personal data has been breached and the situation poses a significant risk to you, we will inform you without undue delay. We do not need to let you know only if we have encrypted your personal data and it is therefore unintelligible to a third party or if we have managed to eliminate the risks arising from the disclosure of your personal data.

Right to lodge a complaint. Not satisfied with the way we process your personal data? If you believe that we process your personal data in violation of generally binding legal regulations, in particular the GDPR and Act No. 101/2000 Coll., on the protection of personal data, you have the right to file a complaint with the Office for Personal Data Protection. But we will be happy if you tell us first and we will sort everything out together.
